OVERVIEW

This website is operated under the business name The Balanced Executive (“The Balanced Executive,” “we,” “us,” or “our”). Throughout this website, the terms “site” and “website” refer to The Balanced Executive website and online store.

The Balanced Executive provides this website, including all information, digital products, resources, tools, services, and other materials available through it, subject to your acceptance of these Terms of Service (“Terms”).

By visiting our website, purchasing a product, downloading a resource, subscribing to our communications, or otherwise using our website or services, you agree to be bound by these Terms and any additional policies referenced in them, including our Privacy Policy and Refund Policy.

Please read these Terms carefully before using the website. If you do not agree to them, you must not access the website, purchase our products, or use our services.

  1. ELIGIBILITY

By using this website, you confirm that you have reached the age of majority in your province, state, or country of residence and have the legal capacity to enter into a binding agreement.

You may not use our website, products, or services for any unlawful or unauthorized purpose or in a manner that violates applicable laws or regulations.

  1. ONLINE STORE TERMS

You agree to provide current, complete, and accurate purchasing and account information for all transactions made through our store.

You are responsible for ensuring that:

  • Your email address and billing information are correct;

  • You have authorization to use the selected payment method;

  • Your device and software can access the digital file format described on the product page; and

  • You download and securely retain your purchased files.

We reserve the right to refuse or cancel an order where we reasonably suspect fraud, unauthorized activity, pricing errors, misuse of promotional offers, resale, redistribution, or a violation of these Terms.

If we cancel an order after payment has been processed, we will provide an appropriate refund unless we reasonably believe the transaction was fraudulent or subject to a payment dispute.

  1. PRODUCTS AND SERVICES

We make reasonable efforts to describe and display our products and services accurately. However, colours and visual details may appear differently depending on your screen, device, printer, paper, or display settings.

Product descriptions, features, contents, page counts, prices, and availability may be changed at any time without notice. Any change will not affect an order already completed unless required to correct an obvious error or comply with applicable law.

At launch, our products primarily consist of digital downloads. We may later offer coaching, consulting, memberships, courses, events, physical products, or other services. Additional terms may apply to those offerings and will be presented before purchase when appropriate.

We reserve the right to discontinue a product or service at any time.

  1. DIGITAL PRODUCTS AND DELIVERY

Digital products are delivered electronically to the email address provided during checkout, through a download page, customer account, or third-party delivery service.

You are responsible for providing a valid email address and checking your spam, junk, promotions, and filtered folders.

Delivery is considered complete when the download link or access instructions have been sent or made available to you. If you do not receive your purchase within a reasonable period, contact us at admin@thebalancedexecutive.ca

Download links may expire or be limited to a reasonable number of download attempts for security purposes. We recommend saving a personal backup immediately after purchase.

If you experience a technical issue accessing a purchased file, contact us and provide your order number and a description of the issue. We will make reasonable efforts to provide a working replacement file or restore access.

  1. DIGITAL-PRODUCT LICENCE

Unless expressly stated otherwise, purchasing a digital product gives you a limited, revocable, non-exclusive, non-transferable licence to download and use that product for your own personal, non-commercial use.

Your purchase does not transfer ownership of the product or any associated intellectual-property rights to you.

You may:

  • Download the product to your personal devices;

  • Print a reasonable number of copies for your own use; and

  • Complete, annotate, and use the materials for your personal career development.

You may not:

  • Share, forward, copy, upload, publish, distribute, sublicense, sell, resell, rent, or give the product or download link to another person;

  • Purchase one copy for use by a team, group, organization, class, or client;

  • Reproduce or adapt the product for commercial use;

  • Use the product to create a competing product, course, workshop, coaching resource, template, or derivative work;

  • Remove copyright notices, branding, watermarks, or other ownership information;

  • Upload the product to shared drives, membership libraries, artificial-intelligence training systems, file-sharing platforms, or public or private online groups; or

  • Claim any part of the product as your own work.

Each individual user must purchase their own copy unless we have granted written permission through a separate team, organizational, or commercial licence.

Unauthorized sharing or commercial use may result in termination of your licence and access without a refund and may expose you to legal action.

  1. REFUNDS FOR DIGITAL PRODUCTS

Because digital products cannot be physically returned after they have been delivered or accessed, purchases of digital downloads are final and non-refundable, except:

  • Where required by applicable law;

  • Where you were charged more than once for the same purchase;

  • Where the file is defective or materially different from its description and we cannot provide a working or corrected replacement; or

  • Where we expressly agree otherwise in writing.

A change of mind, failure to use the product, misunderstanding of the product’s purpose, incompatibility that was disclosed before purchase, or dissatisfaction with personal results does not ordinarily qualify for a refund.

Nothing in this section limits any mandatory cancellation, refund, or consumer-protection right that cannot legally be waived.

Our separate Refund Policy forms part of these Terms and provides additional details.

  1. FUTURE COACHING AND SERVICES

If we offer coaching, consulting, courses, events, memberships, or other professional services in the future, those services may be governed by a separate agreement addressing matters such as scheduling, cancellations, confidentiality, payment plans, participation, and the scope of services.

If additional terms conflict with these Terms, the more specific terms presented for that service will govern to the extent of the conflict.

Purchasing a digital product does not include private coaching, personalized advice, document review, or direct access to the founder unless the product description expressly states otherwise.

  1. FUTURE PHYSICAL PRODUCTS

If we later offer physical products, applicable product pages and policies will describe shipping, delivery estimates, returns, exchanges, and any additional costs.

Delivery dates are estimates unless expressly guaranteed. We will not be responsible for delays outside our reasonable control, but nothing in this section limits rights provided by applicable consumer-protection law.

  1. PRICING, PAYMENT, AND TAXES

Prices are displayed in the currency identified on the website or at checkout. Unless stated otherwise, applicable taxes are calculated and displayed during checkout.

We may change prices at any time, but price changes will not affect completed purchases.

You authorize us and our payment processors to charge the payment method submitted during checkout for the total amount shown before you complete the transaction.

Nothing in this section prevents you from exercising a legitimate right through your card issuer or applicable law.

  1. PROMOTIONAL OFFERS

Discounts, promotional codes, bonuses, and limited-time offers are subject to the conditions presented with the offer.

Unless stated otherwise:

  • Promotional codes cannot be combined;

  • Discounts cannot be applied retroactively;

  • Offers have no cash value;

  • Bonuses are available only during the stated promotional period; and

  • We may cancel an offer affected by fraud, misuse, or an obvious technical error.

  1. EDUCATIONAL-PURPOSE DISCLAIMER

The Balanced Executive provides educational information, professional-development tools, and general career and leadership guidance.

Our products and content do not constitute legal, financial, accounting, tax, medical, mental-health, human-resources, employment, or other regulated professional advice. They are not a substitute for advice from a qualified professional who understands your individual circumstances, workplace, employment agreement, jurisdiction, and goals.

You remain solely responsible for evaluating information and deciding how to apply it.

  1. NO GUARANTEE OF RESULTS

Career advancement depends on numerous factors outside our control, including your performance, experience, qualifications, workplace practices, organizational structure, available opportunities, economic conditions, decision-makers, and individual actions.

We do not promise or guarantee:

  • A promotion, raise, interview, job offer, leadership appointment, or specific career outcome;

  • That an employer will accept or act on a recommendation;

  • A particular financial, professional, or personal result; or

  • That every strategy will be appropriate for every workplace or situation.

Testimonials, examples, scenarios, and case studies illustrate possible experiences and are not promises of typical or guaranteed results.

  1. INTELLECTUAL PROPERTY

The website and its contents—including our digital products, assessments, workbooks, frameworks, templates, copy, graphics, photographs, videos, branding, logos, product names, and overall presentation—are owned by or licensed to The Balanced Executive and are protected by applicable copyright, trademark, and other intellectual-property laws.

No content may be copied, reproduced, republished, uploaded, transmitted, distributed, modified, sold, or commercially exploited without our prior written permission, except for the limited personal-use licence expressly granted in these Terms.

“The Balanced Executive,” “The Promotion Playbook,” associated logos, and related product or program names may be trade names, trademarks, or brand identifiers of their respective owner. No licence to use them is granted except as necessary to identify a legitimately purchased product.

  1. USER SUBMISSIONS, REVIEWS, AND FEEDBACK

If you submit a review, testimonial, comment, suggestion, photograph, or other content, you confirm that:

  • You own or have permission to submit it;

  • It is truthful and not misleading;

  • It does not violate another person’s privacy, intellectual property, or legal rights; and

  • It is not unlawful, defamatory, abusive, discriminatory, or malicious.

You grant us a non-exclusive, worldwide, royalty-free licence to reproduce, edit for length or clarity, publish, display, and use voluntarily submitted reviews or feedback in connection with our business and marketing, unless you and we agree otherwise in writing.

We will not identify you by your full name or use your image as a testimonial without the permissions required by applicable law.

  1. EMAIL COMMUNICATIONS

If you subscribe to our email list or consent to marketing communications, we may send you educational content, announcements, product information, and promotional messages.

You may unsubscribe from marketing emails at any time using the unsubscribe link included in the message. Transactional communications concerning purchases, delivery, security, or customer service may still be sent where necessary.

To the fullest extent permitted by law, the website, products, and services are provided “as is” and “as available,” without representations, warranties, or conditions beyond those expressly stated in these Terms.

We do not exclude or limit any warranty, condition, right, or remedy that applicable law does not permit us to exclude or limit.

This includes, without limitation, loss of income, revenue, employment opportunities, promotions, business opportunities, data, goodwill, or anticipated savings.

Where liability cannot legally be excluded, our aggregate liability relating to a product or service will not exceed the amount you paid for the specific product or service giving rise to the claim, except where applicable law requires otherwise.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability resulting from fraud, wilful misconduct, or any other liability that cannot legally be limited.

To the extent permitted by law, you agree to indemnify and hold harmless The Balanced Executive and its owner, representatives, contractors, and service providers from third-party claims, liabilities, damages, and reasonable costs arising from:

  • Your violation of these Terms;

  • Your infringement of another person’s rights; or

  • Content you submit through the website.

This section does not apply to the extent a claim was caused by our own unlawful conduct.

You may stop using the website at any time.

We may suspend or terminate your access if you materially violate these Terms, misuse a product, infringe intellectual property, engage in fraudulent activity, or create a security risk.

Provisions that by their nature should continue after termination—including intellectual property, disclaimers, limitations of liability, and governing law—will survive termination.

  1. GOVERNING LAW AND CONSUMER RIGHTS

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-law principles.

Any dispute may be brought before a court of competent jurisdiction in Alberta, subject to any mandatory right you have to bring a claim elsewhere under applicable consumer-protection law.

Nothing in these Terms waives or restricts a right or remedy that cannot legally be waived, including applicable consumer-protection rights. If a mandatory law in your jurisdiction gives you greater protection, that law will apply to the extent required.

  1. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted by law or severed where necessary. The remaining provisions will continue in effect.

  1. NO WAIVER

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

  1. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Refund Policy, and any product- or service-specific terms presented before purchase, form the entire agreement between you and The Balanced Executive regarding your use of the website and applicable purchases.

  1. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our products, practices, technology, or legal obligations.

The revised Terms will be posted on this page with an updated effective date. Changes will apply prospectively unless applicable law requires otherwise.

Your continued use of the website after revised Terms take effect constitutes acceptance of those revised Terms.
